4日我局向你单位调查劳动用工、工资支付等情况,并下达《劳动保障监察调查询问通知书》(南人社监询字〔〕第号)要求你单位于日报送有关书面材料到南宁市劳动保障监察支队高新区大队,并接受询问你单位逾期未按要求报送书面材料。日我局向你单位送达《劳动保障监察限期改正指令书》(南人社监令字〔号),限你单位在收到限期改正指令书之日起日内按《劳动保障监察调查询问通知书》(南人社监询字〔〕第号)要求报送书面材料你单位逾期仍未按要求报送有关书面材料,拒不履行我局限期改正指令

你单位经责令改正拒不改正的行为违反了《劳动保障监察条例》第六条:“用人单位应当遵守劳动保障法律、法规和规章,接受并配合劳动保障监察”的规定。

依据《劳动保障监察条例》第三十条第一款第(三)项:“有下列行为之一的由劳动保障行政部门责令改正;对有第(一)项、第(二)项或者第(三)项规定的行为的,处2000元以上万元以下的罚款:……(三)经劳动保障行政部门责令改正拒不改正或者拒不履行劳动保障行政部门的行政处理决定的;……”的规定,我局决定对你单位作出罚款元的行政处罚            

请你单位在收到本处罚决定书之日起十五日内,到南宁市劳动保障监察支队办公室(南宁市民乐路10-4号联系电話:)开具广西壮族自治区非税收入一般缴款书,到罚没代收机构缴纳罚款逾期不缴纳罚款的,依据《行政处罚法》第五十一条第(一)项:“当事人逾期不履行行政处罚决定的作出行政处罚决定的行政机关可以采取下列措施:(一)到期不缴纳罚款的,每日按罚款数額的百分之三加处罚款;……”的规定每日按罚款数额的加处罚款,直至缴清为止

如不服本行政处罚决定,可在收到本行政处罚决定書之日起60日内向广西壮族自治区人力资源和社会保障厅或南宁市人民政府申请行政复议或者自收到本行政处罚决定书之日起六个月内向喃宁铁路运输法院起诉,但不得停止执行本行政处罚决定逾期不申请行政复议也不向人民法院起诉,又不执行本行政处罚决定的我局將依据《中华人民共和国行政诉讼法第九十七条:“公民、法人或者其他组织对行政行为在法定期间不提起诉讼又不履行的,行政机关鈳以申请人民法院强制执行或者依法强制执行。”及《关于实施〈劳动保障监察条例〉若干规定》第四十四条:“当事人对劳动保障行政部门作出的行政处罚决定、责令支付劳动者工资报酬、赔偿金或者征缴社会保险费等行政处理决定逾期不履行的劳动保障行政部门可鉯申请人民法院强制执行,或者依法强制执行”的规定申请人民法院强制执行。
