- ConfidentialityA party receiving CONFIDENTIAL INFORMATION fromthe other party or developing such information hereunder shall keep it instrict confidence, use it solely for the LIMITED PURPOSE authorised under the Agreementand shall not disclose such information in any event for 5 (five) years fromdisclosure thereof but not less that 5 (five) years after the EFFECTIVE DATE,except as follows:a)
tothe extent such acts are permitted by other provisions of the A orb)
tothe extent such information is or becomes general public knowledge through nofault of orc)
tothe extent such information can be shown by contemporaneous docu?mentation ofthe recipient party to have been in its possession prior to rece ord)
tothe extent such information is received by the recipient party from the thirdparty without any breach of an obligation to
tothe extent required by law, by local authorities for regulatory purposes or isnecessary to perform its obligations under the Agreement, in which case therecipient party may disclose the information if the recipient party gives theother party prior notice of such disclosure and an opportunity to comment uponthe content of the disclosure.
